Release of Liability: Please read carefully the following terms and conditions, which constitute the sole, legally enforceable agreements between you and Macalester College.

The liability of Macalester College as sponsor is strictly limited. Macalester College purchases ground transportation, hotel accommodations, restaurant and other services from independent suppliers not under the control of Macalester College. Macalester College therefore is not responsible for any wrongful, negligent, or arbitrary acts or omissions of these independent suppliers, their employees, agents, servants or representatives. Foreign travel also has special risks. Macalester College as sponsor is not liable for injury, illness, death, damage, loss, accident or delay that may be caused by events not within our control, including without limitation, acts or threats of terrorism, war, civil disturbances, strikes, the defect of any vehicle or facility, the negligence, recklessness or default of any third party (including any of the independent suppliers), travel warnings or bans, termination or suspension of war risks or other carrier insurance, quarantine, acts of God or other causes beyond our control. Any such loss would be borne by you. In consideration for being permitted to participate in the tour, you agree to Release and Discharge the College and its employees and agents (the “Released Parties”) from any and all liability for injury, illness, death, damage or property damage or loss arising from your participation in the tour.

You agree not to sue or make claim against the Released Parties for injury, illness, death, damage or loss sustained as a result of participation in the tour or the use of goods and services in connection with your participation in the tour. You also agree to reimburse Macalester College for any sums the College may advance for the purchase of goods or services on your behalf in connection with your participation in the tour.

By forwarding your deposit(s), you certify that you and/or your dependents, minors or others covered thereby do not have any mental, physical or other condition that could create a hazard for them or other participants. We reserve the right to decline to accept or to decline to retain any person as a member of the tour should such person’s health, condition or actions adversely affect or threaten the welfare or safety of other participants or impede the tour. If you have any special needs due to any medical, mental, or physical condition, please contact Gabrielle Lawrence as soon as possible.

Baggage or valuables brought on the tour shall be transported, handled or stored at your risk entirely, and Macalester College shall bear no liability or responsibility for any damage or other loss thereto.
We will make every effort to operate our tours as planned, but we reserve the right to make itinerary changes. If unforeseen circumstances require us to change a hotel, meal or activity, we will select an alternative hotel, meal or activity of comparable quality whenever possible. Macalester College shall not have any liability for any loss or expense resulting from flight cancellation, delays or other unforeseen causes.

No health, accident, disability, personal property, hospitalization or other insurance covering injury to you, or loss or damage to any of your property is included in any fees paid for the tour. You understand that if you desire insurance coverage or protection of any type, it is your responsibility to procure it on your own behalf. Macalester College assumes no responsibility for insurance coverage or protection.

Should any of the provisions of this Agreement and Release, or portions thereof, be found to be invalid by any court of competent jurisdiction, the remainder of this Agreement and Release shall nonetheless remain in full force and effect. This Agreement and Release shall be construed under the laws of the State of Minnesota.
