Introduction

Macalester College encourages the appropriate use of copied material within the spirit and letter of the 1976 U.S. Copyright Law (U.S.C. 107) and the Guidelines for Educational Fair Use. We do not condone a policy of copying instead of purchasing copyrighted works where such copying would constitute an infringement under the copyright law. This policy reflects the changes in copyright procedures and guidelines in the Digital Millenium Copyright Act (HR 2281[pdf formatted fulltext]) signed into law November 3, 1998 to bring the law up-to-date with changes in technology. Sections of the Act are being reviewed for additional revision. Some of the new features include:

  • Designating a copyright agent for the institution
  • Including citations or attributions to sources used for electronic reserves
  • Including a copyright notice on all articles or photocopies provided for interlibrary loan
  • Publishing, disseminating, and increasing institutional general awareness of copyright policies

Copyright at Macalester

The federal copyright laws exist to "promote the useful arts and sciences" as well as to protect the ownership rights of copyright holders. The law, and the College, seeks a balance between higher education's need to easily access and use information for scholarship and the right of the owners of the information to exercise reasonable control of its use. Macalester will take all appropriate measures to ensure that its students, faculty and staff are aware of copyright laws, regulations and agreements and act responsibly as they use information which may be owned by others in the course of teaching, learning or administration of the College. This includes, for example, notification of copyright restrictions at point of use (such as copying machines), promulgation of a detailed copyright policy, and periodic reminders to the community of their responsibility.

  • All Macalester faculty, students, and staff are held accountable to the Responsible Use Policy on Copying.
  • Individuals, not Macalester College, will be held accountable for liability for willful infringement
