{"id":401,"date":"2019-09-11T17:34:05","date_gmt":"2019-09-11T17:34:05","guid":{"rendered":"https:\/\/www.macalester.edu\/160-disability-services\/?page_id=401"},"modified":"2024-04-17T19:48:50","modified_gmt":"2024-04-17T19:48:50","slug":"faculty-and-student-confidentiality","status":"publish","type":"page","link":"https:\/\/www.macalester.edu\/disability-resources\/faculty-3\/faculty-and-student-confidentiality\/","title":{"rendered":"Faculty and Student Confidentiality"},"content":{"rendered":"<p><span style=\"font-weight: 400\">At<\/span><span style=\"font-weight: 400\"> every College or University campus, one person or office is charged with the responsibility of maintaining confidential, disability-related documentation for students with disabilities in order to determine reasonable accommodations for programs or courses.&nbsp;Disability Resources is that office at Macalester.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">The Department of Justice has established that a faculty member generally<\/span><i><span style=\"font-weight: 400\"> does not have a need to know<\/span><\/i><span style=\"font-weight: 400\"> what a specific disability is, only that it has been appropriately verified by (Disability Resources) on behalf of the institution.&nbsp;&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Faculty <\/span><em><span style=\"font-weight: 400\">do have a right<\/span><\/em><span style=\"font-weight: 400\"><em> to know accommodations<\/em> and how these may or may not impact what is essential in their courses; faculty <\/span><i><span style=\"font-weight: 400\">can<\/span><\/i><span style=\"font-weight: 400\"> ask students to provide accommodation letters to substantiate accommodation requests.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">General guidelines for student confidentiality in courses<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">The <strong>Faculty Notification Letter<\/strong> serves as a confirmation of a student\u2019s disability and that they have been through the appropriate process to verify disability.<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">When meeting with a student, discuss only how the indicated accommodations either would or would not fit into course parameters, not disability <\/span><span style=\"font-weight: 400\">specifics. In some cases, faculty may be informed of a specific disability to provide the best access for the student.&nbsp;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Students should not be asked to provide documentation to you directly. Asking for a \u201cdoctor\u2019s note\u201d to miss a class is generally not appropriate if the Faculty Notification Letter indicates accommodations for absence flexibility are needed.&nbsp;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">Do not identify which students in your course require accommodations to other students\/colleagues who don\u2019t have a specific \u201cneed to know\u201d information.&nbsp; Example: discussing if accommodation is appropriate with a Department Chair is reasonable, but not with other faculty colleagues who have no direct educational connection to your course.<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">A good general rule:&nbsp; Before sharing, ask, \u201cWho needs to know this and why?\u201d and for students, \u201cHow can I address their accommodations while respecting medical information?\u201d<\/span><\/li>\n<\/ol>\n\n\n\n<p>Have concerns? Please ask!
