Official Rules: The Macalester Fund Sweepstakes – Big Questions Excursion

HOW TO ENTER THE SWEEPSTAKES: One entry for the Sweepstakes will be made automatically by making a gift to The Macalester Fund between June 1, 2018 and May 31, 2019. Limit one entry per person. Entries with incomplete or false information will be disqualified. Multiple entries will be disqualified.
TIME PERIOD: The Sweepstakes begins on June 1, 2018 at 12:00 a.m. Central Standard Time (Start Date) and ends on May 31, 2019 at 11:59 p.m. Central Standard Time (End Date). No entries will be accepted before the Start Date or after the End Date.
ELIGIBILITY: The Sweepstakes is open only to legal residents of the United States who are eighteen (18) years of age or older as of the Start Date and possess the legal capacity to be bound by and carry out all of the terms and conditions of these Official Rules. Persons in any of the following categories are NOT eligible to participate or win a Prize in the Sweepstakes: (a) persons who on or after the Start Date, were or are employees, enrolled students, or agents of Sponsor, or its subsidiaries, or their subsidiaries, or their respective affiliated companies, franchisees, or service agencies, or independent contractors (including but not limited to all sales representative organizations); and (b) persons who are immediate family (parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses) of any person in any of the preceding categories, regardless of where they live; or who reside in the same household, as any person in any of the preceding categories, whether related or not. THIS SWEEPSTAKES IS SUBJECT TO ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS AND IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
PRIZE: The Prize consists of two domestic round-trip flights and overnight accommodations (one hotel room for night of the event) to attend a Big Questions event of Winner’s choosing during the 2019-2020 academic year. One Prize will be awarded. Prizes are non-transferable, and cannot be exchanged for cash. There are no substitutions for a prize of equal or greater value, except by Sponsor in its sole discretion. Taxes and expenses as a result of winning and using the Prize are the winner’s responsibility. The Prize has an approximate retail value (ARV) of $1,200. The ARV of the Prize represents Sponsor’s good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash. Winners will receive an IRS form 1099 with the above stated value at year-end.
SELECTION AND NOTIFICATION OF WINNERS: One winner and three back- up names for the Prize will be selected by random drawing conducted by Sponsor on or about June 11, 2019. Winners will be notified by telephone or e-mail. If Sponsor is unable to reach the winner or the winner is unable to accept the Prize within 5 days of the first attempt, the unawarded Prize will go to the first back-up and subsequent back- ups thereof until the Prize is awarded. All winners must provide their social security number and complete an affidavit verifying that they meet the eligibility requirements, liability release, publicity release, and any other forms or documents required by Sponsor or by tax or other governmental authorities. A list of the winners will be available on the Macalester College website or by requesting the list from Eva Timmons, Macalester College, 1600 Grand Ave. Saint Paul, MN 55105 or at 651-696-6909. The chances of winning will vary depending upon the number of eligible entries received.
PUBLICITY: By entering the Sweepstakes, each entrant grants Sponsor permission to use the person’s name, address and email address, for the purposes of administration and prize fulfillment, including use in a publicly available winners list. Any use of the forgoing information may be in any manner or media now or hereafter known or existing, including social media, and without compensation, notice or further consent, unless prohibited by law.
LIMITATIONS OF LIABILITY RELEASE: By participating in this Sweepstakes, each entrant agrees that Sponsor and related organizations, their agents and employees (“Released Parties”) have no liability whatsoever for any injuries, losses, or damages of any kind which result from use of the Prize, or by participation in the Sweepstakes. No responsibility is assumed by Sponsor for (a) incorrect or inaccurate entry information or late, unintelligible, illegible, damaged, mutilated, altered, incomplete, misdirected entries received through impermissible channels, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any computer online systems, computer equipment, website, server provider, network, hardware or software; (c) the unavailability or inaccessibility of any website or service; (d) unauthorized intervention in any part of the entry process or the Sweepstakes; (e) typographical, electronic or human errors that may occur in the offer or administration of the Sweepstakes or the processing of entries; or (f) any injury or damage to persons or property, including but not limited to entrant’s computer, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes, or from viewing, playing or downloading any material from Sponsor’s website.
Sponsor reserves the right, without prior notice and at any time, to terminate or suspend the Sweepstakes, in whole or in part, to extend the End Date or to modify the Sweepstakes in any way, should any factor (including but not limited to fraud or security breach) interfere with the Sweepstakes’ proper conduct as contemplated by these Official Rules, or if the Sponsor believes that the Sweepstakes has been or will be compromised in any way. Sponsor reserves the right to void any entry, if it believes such entry was submitted other than as required by these Official Rules or that the entry has been tampered with in any manner.
By participating in this Sweepstakes, each entrant agrees that (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes or the Prizes awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs, associated with entering the Sweepstakes, but in no event will attorneys’ fees be awarded or recoverable; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressly waives all rights to, punitive, incidental or consequential damages and/or any other damages other than actual out-of-pocket expenses.
The winner, by accepting the Prize, agrees to release and hold harmless the Released Parties from any and all liability, claims or actions of any kind whatsoever, which may result from the award, receipt, enjoyment, ownership or use or misuse of the Prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, or any claims, costs, injuries, losses, or damages related to or based on the entrant’s rights of publicity or privacy, or the entrant’s claim that he/she has somehow been defamed or portrayed in a false light).
Sponsor does not assume any responsibility for any schedule changes in the Sweepstakes timeline, including without limitation, scheduling conflicts, labor strikes, Acts of God, or other unforeseen events that disrupt the Sweepstakes schedule.
ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SWEEPSTAKES ENTITIES IN CONNECTION WITH THIS SWEEPSTAKES SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF MINNESOTA WITHOUT GIVING EFFECT TO ANY CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS. THE INVALIDITY OR UNENFORCEABILITY OF ANY PROVISION OF THESE RULES SHALL NOT AFFECT THE VALIDITY OR ENFORCEABILITY OF ANY OTHER PROVISION. IN THE EVENT THAT ANY PROVISION IS DETERMINED TO BE INVALID OR OTHERWISE UNENFORCEABLE OR ILLEGAL, THESE RULES SHALL OTHERWISE REMAIN IN EFFECT AND SHALL BE CONSTRUED IN ACCORDANCE WITH THEIR TERMS AS IF THE INVALID OR ILLEGAL PROVISION WERE NOT CONTAINED HEREIN. EACH PERSON WHO PARTICIPATES IN THIS SWEEPSTAKES AGREES THAT THE STATE AND FEDERAL COURTS LOCATED IN ST. PAUL, MINNESOTA HAVE EXCLUSIVE JURISDICTION OVER ANY SUIT OR OTHER PROCEEDING ARISING OUT OF OR BASED UPON THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SWEEPSTAKES ENTITIES IN CONNECTION WITH THIS SWEEPSTAKES AND EACH HEREBY WAIVES ANY CLAIM THAT IS NOT SUBJECT PERSONALLY TO THE JURISDICTION OF SAID COURTS OR THAT ANY SUCH SUIT OR OTHER PROCEEDING IS BROUGHT IN AN INCONVENIENT FORUM OR IMPROPER VENUE.
RESTRICTIONS: By participating in this SWEEPSTAKES, each participant agrees to be bound by these Official Rules, and by the decisions of Sponsor, which are final and binding in all respects. Winner is responsible for any and all applicable federal, state, and/or local taxes, license fees, and other expenses required to receive and use the Prize including, without limitation; food, ground transportation and parking, gratuities, and miscellaneous expenses.
