What are my reporting obligations as a Macalester Student Employee? Student employees who oversee, assign work to, train, or advise other students, formally or informally, have a duty to report to the Title IX Coordinator if they receive information or witness possible prohibited conduct under Macalester’s Title IX Policy while at work or while otherwise performing job duties. This applies while students are working or performing their job duties. Students are not required to report if the incident involves someone they do not supervise, advise, or instruct in their role. An exception is made to this for Resident Assistants (see below).

I am a Resident Assistant (RA) in a residence hall. What are my reporting obligations? Given the scope of the role, RAs always have a duty to report information they receive about Prohibited Conduct to the Title IX Coordinator, even while not formally on duty. If you have questions about whether the information should be reported, the student employee should seek guidance from the Title IX Coordinator before providing any identifiable information regarding the report.

Do I have a reporting obligation if a student I tutor disclosed to me that they were sexually assaulted? Yes. Student employees are required to report allegations of sexual assault to the Title IX Coordinator if it is possible that the sexual assault: (1) occurred on Macalester property; (2) occurred during a Macalester program or activity; (3) was committed by a current Macalester member at the time it took place. In most cases, student employees should share information to the Title IX Coordinator because they will have insufficient information about a particular allegation to be certain that it does not need to be reported. We encourage student employees to consult with the Title IX Coordinator even if the above three situations are not present so that we can offer supportive resources to the student.

Do I have a reporting obligation if a student discloses prohibited conduct to me in a written assignment? Yes. Student employees must report allegations of prohibited conduct learned through any aspect of their employment duties, including written work.

If prohibited conduct occurs off campus, does it need to be reported to the Title IX Coordinator? Yes, if either the respondent or complainant is a current Macalester member or if the prohibited conduct may have occurred in the context of a Macalester program or activity.

Should I advise students I work with of my reporting obligations in advance? Yes. If you interact with the students regularly, you should notify them about your obligations to report prohibited conduct to the Title IX Coordinator. This may be done in many ways including, but not limited to, one-on-one meetings with students, group meetings, and course syllabi.

What happens when a report is made to the Title IX Coordinator? The Title IX Coordinator or Deputy will reach out to the complainant to provide resources for personal support, as well as information about their rights and possible pathways to address the incident. Students are not obligated to respond to outreach from the Title IX Coordinator or Deputy, and they are not required to participate in formal procedures. Our primary concern is to offer appropriate support for students.
